Refund Policy

1. Summary: All Sales Final After Access Granted
Axion Algo is a digital product. The product is a TradingView indicator (and the access that unlocks it) which we deliver electronically and instantly. Because performance of the contract begins the moment your payment clears, and because the product cannot be “returned” in any meaningful sense once the access invitation has been sent to your TradingView username, our rule is straightforward: all sales are final once access has been granted.
This page sets out, in detail and by jurisdiction, when this rule applies, when it does not, and what exceptional circumstances entitle you to a refund. Read it carefully before purchasing. By completing checkout you confirm that you have read, understood and accepted this Refund Policy and that you waive any statutory cooling-off period that would otherwise allow you to revoke the purchase of digital content delivered immediately.
Nothing in this document attempts to exclude or limit a non-waivable statutory consumer guarantee. Where local law grants you a right that cannot be contractually waived, that right survives this policy.
2. Definition of “Access Granted”
Axion Algo delivers the indicator by adding your TradingView username to the indicator's access list inside TradingView. Once we submit that invitation, the product is considered delivered. Specifically, “access granted” means the moment our systems send the access invitation to TradingView for the username you provided at checkout, irrespective of whether you have logged into TradingView to accept it, opened the indicator, added it to a chart, or used it on a live or demo account.
The reasons for this definition are technical and commercial:
- Once an invitation is issued, the indicator's closed-source logic is, from our perspective, in your possession; the access cannot be silently revoked without you noticing, and we have incurred the irreversible operational cost of provisioning you.
- We cannot verify, after the fact, whether a user copied, screenshotted, or reverse-engineered the indicator while it was provisioned to their account. Allowing “try and refund” would be commercially abusive.
- The act of granting access is logged with a server-side timestamp, the TradingView username and the order ID. This log is the authoritative record for any dispute.
If you provide an incorrect TradingView username at checkout and the invitation is sent to a username you do not control, contact our contact form within 24 hours. We will revoke the misdirected invitation and grant access to your correct username; this is not a refund event.
3. EU / UK Right of Withdrawal — Express Waiver
EU consumers normally enjoy a 14-day right of withdrawal under Directive 2011/83/EU on consumer rights. UK consumers enjoy an equivalent right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Both regimes permit the consumer to lose that right where the contract is for the supply of digital content not on a tangible medium, provided the consumer has expressly consented to immediate performance and acknowledged that the right of withdrawal will be lost as a consequence.
3.1 Statutory text — Article 16(m), Directive 2011/83/EU
“Member States shall not provide for the right of withdrawal set out in Articles 9 to 15 in respect of distance and off-premises contracts as regards the following: (m) the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and his acknowledgment that he thereby loses his right of withdrawal.”
3.2 Statutory text — UK CCRs 2013, Regulation 37(1)
“Under a contract for the supply of digital content not on a tangible medium, the trader must not begin supply of the digital content before the end of the cancellation period… unless (a) the consumer has given express consent, and (b) the consumer has acknowledged that the right to cancel the contract under regulation 29(1) will be lost.”
3.3 How you waive the right at our checkout
At checkout, every EU and UK customer must tick a checkbox reading substantially as follows:
“I expressly consent to Axion Algo beginning performance of the contract (granting me access to the indicator on TradingView) immediately upon payment confirmation, and I acknowledge that I will thereby lose my 14-day right of withdrawal as soon as access is granted.”
Without ticking this box you cannot complete the purchase. By ticking it and clicking “Pay”, you have given the prior express consent and acknowledgment required by Article 16(m) and Regulation 37, and your right of withdrawal is lost the moment we send the TradingView access invitation. Absent this express waiver you would have 14 days to cancel and receive a full refund; with the waiver, no withdrawal right survives delivery.
If, for any reason, the waiver checkbox is missing from your checkout flow (a bug on our end) and you are an EU or UK consumer, the 14-day statutory withdrawal period applies and you may exercise it by emailing our contact form within 14 days of purchase.
4. California Subscription Cancellation Disclosure
For subscribers whose billing address is in California we comply with the California Automatic Renewal Law as amended by AB 390, AB 1146 and SB 313. We disclose all of the following at signup, in the order confirmation email, and in this policy:
- Recurring nature. Axion Algo is a subscription service. By purchasing you authorise Axion Algo (via our payment processor, Stripe) to charge your payment method on each renewal date until you cancel.
- Renewal frequency and amount. Monthly plans renew every 30 days at the price displayed at checkout, plus applicable taxes. Annual plans renew every 365 days at the displayed price. Any future price change is communicated in advance per section 14.
- Easy cancellation. You can cancel online, without speaking to anyone, from your account dashboard in a single click. We do not require a phone call, a postal letter, or a chat session. You also do not need to provide a reason.
- 7-day advance renewal email. Per California SB 313, no later than 7 calendar days before each renewal we send you an email reminder containing the renewal date, the amount that will be charged, the payment method on file, and a direct link to cancel.
- No silent free-trial conversion. If we ever offer a free trial that converts to paid, we will obtain an additional affirmative consent before any charge, in line with SB 313.
5. Brazil — CDC Article 49
Brazil's Código de Defesa do Consumidor, Article 49, grants a consumer the right to withdraw from any contract concluded at a distance (“fora do estabelecimento comercial”) within 7 days of the agreement or the receipt of the product or service. For digital content delivered instantaneously, Brazilian authorities and courts have generally accepted that this right can be expressly waived when performance begins immediately with the consumer's informed consent, by analogy to the European regime.
At checkout, every Brazilian customer must tick a checkbox reading substantially as follows:
“Eu autorizo expressamente a Axion Algo a iniciar a execução do contrato (concessão de acesso ao indicador no TradingView) imediatamente após a confirmação do pagamento e reconheço que, ao fazê-lo, perco o direito de arrependimento de 7 dias previsto no artigo 49 do CDC.”
Ticking this box is a condition of completing the purchase. As soon as we grant TradingView access the right of withdrawal under Article 49 is extinguished and the no-refund rule of this policy applies. If the waiver was not presented to you (a bug), the statutory 7-day right applies and you may exercise it by email.
6. Australia — Australian Consumer Law (ACL)
The Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) does not grant a right to a refund for change of mind. A trader may lawfully refuse a refund where the only reason given is that the consumer no longer wants the product. We do exactly that.
At the same time, the ACL grants statutory consumer guarantees that cannot be excluded by contract: in particular, that goods or services are of acceptable quality, fit for any purpose disclosed, and match their description. Those guarantees survive this policy.
Under the ACL a refund (or replacement, or compensation) is only owed where there is a major failure. In the context of Axion Algo, a major failure would mean, for example, that we are permanently unable to deliver the indicator you paid for. It does not mean:
- that the indicator produced losing trades;
- that you did not understand how to use it;
- that you preferred a competing product after using ours.
For any genuine major failure, contact our contact form; we will engage in good faith and, where the ACL requires it, issue a refund.
7. Other Jurisdictions
We sell globally. The following is a non-exhaustive summary of how this policy interacts with selected jurisdictions outside the EU, UK, US (California), Brazil and Australia. In all cases the rule is the same as the global rule: digital content delivered immediately equals no refund, unless local non-waivable law provides otherwise.
- Canada. Consumer protection is provincial. Provinces such as Ontario, Quebec, British Columbia and Alberta do not, in general, mandate a statutory cooling-off period for digital content delivered immediately. Specific industry regulations (e.g., direct sales) do not apply to SaaS subscriptions purchased on the trader's own website.
- Japan. The Act on Specified Commercial Transactions (特定商取引法) does not impose a cooling-off period on mail-order / online sales of digital content where the trader's refund policy is clearly disclosed before purchase. This page is that disclosure.
- Singapore. The Consumer Protection (Fair Trading) Act does not grant a cooling-off period for online purchases of digital content. Statutory implied terms of satisfactory quality survive.
- India. The Consumer Protection (E-Commerce) Rules 2020 require clear disclosure of the refund policy. This page is that disclosure. There is no general statutory cooling-off for digital content delivered immediately.
- Switzerland, Norway, Iceland. Treated equivalently to the EU regime above, including the express waiver of the right of withdrawal for digital content delivered immediately.
- All other jurisdictions. The no-refund rule of this policy applies unless local non-waivable law requires otherwise. If your local law grants you a non-waivable refund right, contact us with the citation and we will honour it.
8. Subscription Cancellation Process
You can cancel your subscription at any time, in one click, from your account dashboard (Settings → Billing → Cancel subscription). You do not need to contact support, justify your decision, or wait for a representative.
It is important to understand the difference between cancellation and refund:
- Cancellation stops all future charges. It does not return any past payment. When you cancel, your subscription remains active until the end of the period you have already paid for, and access is revoked at that period's end.
- Refund returns a past payment to your original payment method. Refunds are issued only in the exceptional scenarios listed in section 10.
Cancellation is not pro-rated. If you cancel on day 5 of a 30-day billing cycle, you keep access for the remaining 25 days; we do not refund the unused portion. This rule mirrors the standard practice of TradingView, Netflix, Spotify and other digital subscription services and reflects the fact that you have had continuous access to the product throughout the cycle.
Cancelling does not delete your account; you may reactivate at any time, in which case the then-current price applies unless you are a grandfathered launch-rate subscriber (see section 14).
9. Chargeback Policy
A chargeback is a forcible reversal of a payment initiated through your card issuer or bank, bypassing us. We treat all chargebacks as suspected fraud until proven otherwise, for the following reasons:
- You received the service: access to the indicator was granted and logged on our server.
- You had a one-click, no-questions-asked cancellation method available to you in your dashboard.
- You had a direct support channel at our contact form.
If you nevertheless file a chargeback while having received the service, the following consequences apply immediately and irreversibly:
- Account termination. Your Axion Algo account is terminated, TradingView access is revoked, and you are removed from all community channels (Discord, mailing list, etc.).
- Blacklist. Your email address, payment method fingerprint, billing address, IP address and TradingView username are added to an internal blacklist. You will not be able to re-subscribe in the future.
- Dispute defence. We will contest the chargeback with the following evidence: server-side timestamp of the access grant, the TradingView username we provisioned, IP and device logs of the checkout session, the waiver checkboxes you ticked (with timestamps), the renewal reminder emails delivered to you, and the absence of any prior contact with support.
- Pass-through of the Stripe chargeback fee.Stripe charges us a fee of US$15 per chargeback regardless of outcome. This fee is treated as a cost of collection and is billed back to you. If unpaid, the debt may be referred to a collection agency in your jurisdiction.
10. Exceptional Cases Where a Refund IS Issued (Full Refund)
Notwithstanding the no-refund rule, we will issue a refund in the following limited cases:
10.1 Technical inability to deliver
If, due to our error, we cannot grant TradingView access within 24 hours of payment confirmation, we will automatically refund the charge in full. You do not need to ask. The 24-hour clock pauses if the delay is attributable to you (e.g., an invalid TradingView username) or to TradingView itself.
10.2 Double billing
Any duplicate charge for the same subscription period (caused by a payment-processor retry, browser double-submit, or our error) is refunded immediately on detection by our reconciliation process, or upon your report — whichever happens first.
10.3 Unauthorised fraudulent charge
Where you can demonstrate to our reasonable satisfaction that your payment instrument was used without your authorisation (typically by providing a police report number, a card-issuer fraud reference, or evidence of stolen credentials), we will refund the charge in full, terminate the account, revoke TradingView access, and cooperate fully with the card issuer's fraud investigation, including providing any access logs, IP addresses and timestamps they request.
10.4 Service permanently discontinued by Axion Algo
If we permanently discontinue the Axion Algo indicator service before the end of a paid subscription period, we will refund the unused portion of that period on a pro-rata basis. This is the only circumstance in which we issue a pro-rata refund.
11. No-Refund Scenarios — Comprehensive List
The following scenarios do not qualify for a refund. The list is illustrative, not exhaustive; any scenario not falling within section 10 is by default a no-refund scenario.
- Change of mind after purchase. You decided after paying that you would rather not have the subscription.
- “The indicator didn't make me profit.” Trading results depend on the user, the market, position sizing, risk management and many other factors outside our control. Past performance is not a guarantee of future results. Profitability is not a feature we sell.
- You forgot to cancel before renewal. You received a 7-day advance reminder email containing a one-click cancellation link. Failure to act on it is not a refundable event.
- You stopped using the product but did not cancel. A subscription is a recurring authorisation to charge; it does not pause itself because you stopped opening TradingView.
- You found a cheaper competitor. Competitive pricing is a market reality and is not a refundable event.
- Personal financial circumstances. Job loss, divorce, illness, bereavement and similar hardships are serious and we are sympathetic, but they do not create a contractual right to a refund. You may cancel immediately to avoid future charges.
- Market conditions changed. We do not refund because volatility was unusual, because a central-bank decision moved the market, or because a particular trading session was quieter than expected.
- TradingView platform outage. When TradingView is down, our indicator cannot run. We do not control TradingView and we do not refund for TradingView downtime.
- Broker compatibility issue. Whether your broker supports the symbols, the timeframe or the order execution model you wish to use is an integration concern between you, TradingView and your broker.
- Subjective dissatisfaction with signal frequency. You feel the indicator produced too few or too many signals for your taste.
- Subjective dissatisfaction with signal quality. You feel the signals were not as accurate as you hoped.
- You could not figure out how to use it. We ship written documentation, a YouTube walk-through, a Discord community and a direct support email. Use them.
- You claim you did not know it was a subscription. Every checkout page, every CTA, every confirmation email and every receipt clearly states the recurring nature, the renewal cadence and the amount.
- You bought Starter but wanted Premium (or vice versa). You can upgrade or downgrade from the dashboard at any time; the price difference is pro-rated by Stripe automatically. No refund is needed.
- You claim you never received our emails.Check your Spam / Promotions folder and our Discord channel before reporting the issue. If our emails are landing in spam, that is a deliverability matter for which we will help you whitelist us; it is not a refundable event.
- You claim you were “scammed” without evidence. Unsupported accusations are not a basis for a refund. We respond to evidence, not to emotion.
- Trading losses incurred while following signals. You are solely responsible for your trading decisions. See the Disclaimer.
- Your preferred asset is not yet covered by a preset. The presets and instruments supported are listed before purchase. New presets are added at our discretion and are not a refundable promise.
- You cannot legally trade in your jurisdiction.It is your responsibility to verify the legality of trading and of using third-party indicators in your country. See the Disclaimer.
12. How to Request a Refund (for valid scenarios only)
If your case falls squarely within section 10, request a refund by emailing our contact form with the subject line:
Refund Request — [order ID]
The body of the email should include:
- your Stripe receipt or payment confirmation;
- the TradingView username on file;
- the email address associated with your Axion Algo account;
- a brief description of the qualifying scenario (10.1, 10.2, 10.3 or 10.4) and any supporting evidence;
- the payment method on which you wish to receive the refund (must be the original payment method).
We respond within 5 business days. If the request qualifies, the refund is issued to the original payment method; depending on the issuer, funds typically reappear within 5 to 10 business days. If the request does not qualify you will receive a written explanation citing the applicable section of this policy.
13. Stripe Dispute Process — Cross-Reference
Stripe gives you the ability to open a dispute (chargeback) through your card issuer at any time. Before doing so, please contact our contact form. The vast majority of issues that lead customers to consider a dispute are resolvable in one email exchange (mis-typed TradingView username, duplicate charge, unfamiliar billing descriptor, expired card on file, etc.).
Filing a Stripe dispute without prior contactwith us is treated as bad faith and triggers the consequences set out in section 9 (account termination, blacklist, pass-through of the Stripe fee, debt collection if unpaid). The fact that Stripe's flow makes it possible to click “Dispute charge” in two taps does not make it the right first step; talk to us first.
14. Pricing Changes
Existing subscribers are grandfathered at the price they were paying at the time they first subscribed to a given plan, for as long as their subscription remains continuously active. If you cancel and resubscribe later, the then-current price applies; you do not retain the previous rate.
Launch-rate subscribers (those who purchased during an explicitly marked launch promotion) keep the launch price forever as long as their subscription remains continuously active. Downgrading from a higher tier to a lower tier does not move you off the launch rate; cancelling does.
Any future price increase for new customers is announced on our website at least 30 days in advance. Grandfathered subscribers continue at their existing price irrespective of the new published price.
15. Recurring Billing Notice Procedure
Per California SB 313, the UK Consumer Contracts Regulations, the EU Omnibus Directive and basic transparent-renewal best practice, we send a renewal reminder by email no later than 7 days before each renewal. The reminder contains:
- the upcoming renewal date;
- the exact amount to be charged, in your billing currency;
- the payment method on file (last four digits for cards, wallet name for digital wallets, “Crypto” for crypto flows);
- a direct, deep-linked one-click cancellation button that does not require you to re-authenticate using a password;
- a link back to this Refund Policy.
For annual subscriptions, an additional reminder is sent 30 days before renewal in addition to the 7-day notice. If you do not receive the reminder, check your spam folder and our Discord channel; failure to receive it (e.g., because emails went to spam) is not, on its own, a refundable event but we will of course help you investigate deliverability.
16. Currency, VAT and GST
Prices are displayed in US dollars (USD) by default. Where Stripe detects an EU or UK billing address, VAT is added at the rate applicable in the buyer's country. Where Stripe detects an Australian billing address, GST is added at 10%. Equivalent taxes are added where local law requires.
Indicative rates (subject to legal change without notice on our side):
- United Kingdom: 20% VAT
- European Union: country-specific VAT (e.g., Spain 21%, Germany 19%, France 20%, Ireland 23%)
- Australia: 10% GST
- Norway, Switzerland, Iceland: country-specific VAT
- United States: state-level sales tax where Stripe Tax has determined nexus
If a refund is issued under section 10, the tax component is refunded together with the principal for the same transaction. However, where a subscription is cancelled rather than refunded, taxes already collected and remitted to the relevant tax authority are not returned by us — they are the property of the tax authority, not ours.
17. Crypto Payment Refunds
We accept crypto payments (BTC, ETH, USDC, USDT and others as listed at checkout) through a third-party processor. Where a refund qualifies under section 10 for a crypto-paid subscription, the refund is returned in the same crypto, in the same amount of cryptoas the original payment.
We do not bear exchange-rate risk on crypto refunds. Concretely: if you paid 0.0025 BTC for a monthly subscription when 1 BTC was worth US$60,000, and at refund time 1 BTC is worth US$80,000 (or US$40,000), you will receive 0.0025 BTC. You will not receive the USD-equivalent of what you paid. This rule is symmetric: it applies whether the crypto has appreciated or depreciated since payment.
Crypto refunds are sent to a wallet address that you provide and confirm by email. We require email confirmation of the wallet address from the same email address on the account, plus a small signed proof-of-ownership message where the processor supports it. We are not responsible for funds sent to a wallet address whose ownership you confirmed but which turns out to be wrong or compromised — once a blockchain transaction is broadcast and confirmed, it is irreversible.
Network fees (gas, miner fees) for the refund transaction are deducted from the refund amount.
18. Affiliate Commission Reversal
Axion Algo operates an affiliate programme that pays commission on referred sales. If a refund is issued for a referred sale, the corresponding affiliate commission is reversed from the affiliate's balance. If the commission has already been paid out to the affiliate and the affiliate balance is insufficient to cover the reversal, the negative balance is carried forward against future commissions.
Affiliates expressly acknowledge this reversal risk when joining the programme. It is the natural consequence of treating the referral commission as economically dependent on the referred sale completing.
19. Tax Withholding on Refunds
We do not withhold any tax on refunds processed under this policy. The full refund amount is returned to the original payment method. Where applicable taxes were added at the time of purchase (VAT, GST, sales tax), those taxes are refunded as part of the total refund of that transaction and the credit is processed through our tax provider on the next reconciliation cycle.
It is your responsibility to declare any tax consequence of a refund in your own jurisdiction (for example, if you had deducted the original purchase as a business expense).
20. No Right to Refund Negotiation
Refunds are not negotiable. Either your situation falls squarely within one of the exceptional scenarios in section 10, in which case the refund is issued; or it does not, in which case no refund is issued. We do not offer:
- partial “goodwill” refunds;
- account credits in lieu of cash refunds;
- discount coupons in exchange for not pursuing a refund request;
- tier upgrades, free months or other concessions as a negotiated alternative to refund.
This rule is uniformly applied to every customer to keep our refund decisions predictable, defensible and fair.
21. Limitation Period to Request a Valid Refund
Even where a refund would otherwise qualify under section 10, the request must reach us within 30 days of the charge. Requests made later than 30 days from the charge date are denied without further examination, except where local non-waivable law requires a longer period.
This limitation exists for accounting, reconciliation and chargeback-defence reasons. Our records are most accurate during this window; thereafter the cost of reconstructing the transaction context is disproportionate to the value of an individual subscription charge.
22. Bad-Faith Refund Requests
The following behaviours are treated as bad faith and disqualify the requester from any refund, regardless of the underlying merit of the claim, and trigger the consequences of section 9 (termination, blacklist):
- Repeated refund requests for the same scenario after a written denial.
- Threats of chargeback as a means of pressuring us to refund (“refund me or I'll dispute”).
- Public defamation in exchange for a refund — for example, posting or threatening to post defamatory reviews unless we refund.
- Conditioning the non-publication of a negative review on a refund. The decision to leave a review is independent from the decision to refund; coupling them is extortion.
- Multiple-account abuse — creating fresh accounts after termination to attempt new purchases and new refunds.
- False fraud claims against your own card issuer for charges you authorised.
In addition to termination and blacklist, we reserve the right to report bad-faith behaviour to the applicable consumer protection authority, to your card issuer's fraud team, to Stripe's Radar fraud network, and where the behaviour involves extortion or defamation, to local law-enforcement authorities.
23. Disputes
Disputes over a refund decision are resolved in accordance with the dispute-resolution clause of our Terms of Service, including the governing-law and arbitration provisions set out there. Nothing in this section deprives you of any non-waivable right under your local consumer-protection regime, including the right to bring a claim before the competent court or alternative-dispute-resolution body of your country of residence.
24. Modification of this Policy
Axion Algo, operator of axion-algo.com, may update this Refund Policy from time to time, for example to reflect changes in law, payment processors, or product structure. The revised version carries a new “Last Updated” date at the top of the page.
For material changes — changes that meaningfully reduce your rights under this policy — we notify active subscribers by email at least 30 days in advance of the change taking effect. Continued use of the service after the effective date constitutes acceptance of the revised policy. If you do not accept the change, you may cancel your subscription before the effective date and your existing rights under the previous version continue to apply to any pre-existing charge that remains within the 30-day limitation period of section 21.
Non-material changes (typo fixes, clarifications that do not change the substance, formatting changes) take effect on publication without individual notice.
